Well, to be honest, I had kind of figured that they would come after the soup eventually. As people state so clearly in so many places here, it's a community. It's not simply a bit torrent site that they can target as "evil copyrighted material distribution central", it's a place that shows quite clearly that there are intelligent people involved in this, that it's not about criminal activity, in fact, filesoup makes the entire internet bit torrent community look better. In many ways this would make filesoup a high priority target as your average joe internet user could come here, even with no interest in bit torrent whatsoever, and hang out, have a good time, and realize, "hey, all these guys (and girls) who're into bit torrent are just like me, they're not the internet version of the crackhead or career criminal". Filesoup has the unique position of being able to garner public support because it is such a friendly open place, and if we were to do that it would be the beginning of the end for the MPAA goon squad and the way they do business.
So let us get together and do this, let us support Geeker, and support the soup. Talk to friends, IRL ones too, get the word out, Geeks, consult your lawyers and think about talking to the papers, the six o'clock news. Lets start to rock their boat from the ground up. If we can get the public behind us, behind Geeker then we will be able to not only defend our site, nor our Geeker, but our whole larger community that filesoup stands for. I think it's time we go on the offensive, an intelligent, thought out, LEGAL offensive. Geeker, you let us know what we can do to help, I for one, while I haven't had the luxury of being able to donate to filesoup, ever, I will do what I have to in order to be able to donate and help with your, indeed, with all of filesoups defense. WE ARE FILESOUP, HEAR US ROAR! |

This news is terrible, I really feel for you and your family Geeks
I know copyright infringement is a problem for the entertainment moguls and the companies that leech off them, they are losing revenue. But going after site owners is never the answer, they always get it wrong and grab the wrong people, they should be looking for the people who download and make copies to sell on for profit, i noticed in the list there wasent any duplicating equipment there, this should have told them you are not the type they are after.. I hope members will stand by you and Filesoup, you and they/we have done and are doing nothing wrong imho, the police time would be better spent chasing down Paedolphiles, who use the kids sites for their perverted intent. Keep yer chin up and give the dog lottsa hugs |

I'm so terribly sorry to read about your ordeal, Geeker. Knowing about the outrageous disporportionate actions regarding filesharing isn't quite the same as actually being confronted with it. If there is anything I can do to help you, let me know. *hugs*

It has been a long time since I've lost my trust in the law enforcement agencies and the justice system... They are only the guard dogs for the rich and powerful.

FACT view filesoup as a business because it receives donations, its as simple as that. You receive monetary gain from your users therefore you profit from whatever the site does. Yes of course it is donations for the servers etc but that will not cut any ice with FACT. I can give my money to whoever I want. I have given my money to friends at work and to my friends here. I challenge anyone to PROVE I gave it to them merely because this site exists instead of to my friends for whatever personal use they deemed fit. Its all point of view. Best Wishes Red One. OMG, sorry to say Geeker your email saddened, but didn't surprise me. the authorities seem to be squeezing and crushing all forms of creativity and community whilst on the other hand employing hackers and crackers and employing them in m i 5 or wherever. i have to say i think you handled a very difficult situation brilliantly.i can't see anywhere where you went wrong. you've had some great advice from the other posters and i unfortunately am not clever or learned enough to add anything different. but ail i would like to say is that 'the harder they hit the harder they will fall'.

i think you should get in contact with the human rights office as yours were clearly violated you were treated like a terrorist. I am in the USA. But our justice system is based on yours. I would find a good lawyer and sue for defamation of character, and sue for damages plus public worldwide humiliation. I would not settle for less than 5 million dollars, whatever that comes to in your country. In this country, I would win. You should win also being that our justice systems are similar. Good luck pal. I'm sure you will find a lawyer that will take on this cae at no cost to you and get paid from the winnings. |

I've been illegally arrested by the filth myself. Held for a day and never charged but fingerprinted and photo'd. That's all they wanted I guess... There's too much good advice here to add much but now I wish I could've seen the below vids from The Anti-terrorist before they grabbed me...

Not only is this complete injustice but a direct violation to the Privacy Act and Human rights Act.
NO police officer has the legal right to refuse you 1 phone call, no matter what a piece of paper states. what they did was seriuosly unprofessional and i will bring thiis to the attention of my local media and to the attention of all members of my website. you have The Dj's Link's full support. |

It was foolish to keep begging police officers for permission to call someone to care for your dog. One phone call to you lawyer, which cannot be denied, was all that was necessary to provide for your dog's care. Why did you need to wait for the police to drive you home? Your lawyer was present. Doesn't he own a car? If you are operating a website involving the distribution of copyrighted material you would have to be an imbecile not to know that you might be liable for prosecution. You should have made comprehensive contingency plans to protect you property and provide a legal defense in the event the police showed up at your door. It is moronic to pretend that you are shocked your activities resulted in legal problems.

It is moronic to pretend that you are shocked your activities resulted in legal problems. Strange, I’ve re-read the email and postings, but I seem to have missed the part where it says he was begging – but there again, I contained myself to reading what was written and not just read it and interpreted it for my own dramatic effect And as for geeker requesting that he should be allowed to exercise his rights in accordance with PACE, in regards having someone contacted of his arrest Although PACE might allow for being held incommunicado, but when this is being done then its necessity and continuance should be reviewed at regular intervals And there’s certainly nothing wrong, with reasserting your desire to have all your arrest and detention rights restored – By asking for someone to be informed In fact in the present instance: As the authority for being held incommunicado was lifted and geeker asked repeatedly to be awarded his rights in accordance with PACE, yet was still denied those rights by being held incommunicado and being refused his right to inform someone of his arrest Then despite your misguided and barbed comments of “It was foolish to keep begging police officers for permission to call someone to care for your dog” it could actually assist him as well, due to them having denied him of these rights If he was to follow your wise words and didn’t ask, then once the authority to be held incommunicado had expired, then they wouldn’t have denied him his rights - as the opportunity to do so wouldn’t have arose As for the idea that someone in detention and being held incommunicado could facilitate communication to the outside world via their lawyer – whilst this might well happen, but your average solicitor and average client aren’t going to run the risk of such foolhardy arrangements, that could see them both being arrested And as an aside, and although not specific to these circumstances, yes you can under certain circumstances be denied access to a lawyer within England and Wales – and in the case of Scotland, then the first six hours is a lawyer free zone, regardless of what the offence might be So you might want to reconsider your position in regards your comments about that as well As for the lift via the police, and despite your comments about that as well, it is of paramount importance - This is because people who are under arrest and have had their detention authorized are placed in police cells, not people who are awaiting a lift, as they aren’t waiting rooms So should geeker have been charged and or bailed at that point in time, then in affect he was as free as the next man, but by placing him back into a cell he was being imprisoned again – something which definitely needs exploring EDIT: to add a missing "but" This post has been edited by enigmaenigma: Aug 4 2009, 04:44 PM |

This sucks... but by my personal experience I can tell you that that is normal procedure for the police... The law has many holes regarding your rights once you are under investigation or detention. My brother is a very nice guy that has a different way to see life (lets leave it that way), I was once confused for him by the police and I expend 72h at the police station b4 I was sent to courts (the protocol in Spain) even with my Spanish passport, my ID and my Norwegian ID in my possession at the moment of the detention, they keep saying that I was my brother and that was excuse enough to keep me in that smelly cell for 3 freaking days. My lawyer told me very honestly that there was nothing to do, I could sue them and be at courts for 10 years but, the only thing I would get is old, and a lot to bills to pay to have that cause at courts.
Not being negative... so, go for it and I hope they get punished for what they did to you, if you get it I will take it like my own revenge. So far... I have copy&paste your email to a new email and I have translate to Spanish what you wrote to be able to send it to all my contacts list and to my friends from the south of Europe. I hope it helps at least to make ppl think about if it doesn't goes more far than that. I will try to be more active in the forum when the winter locks me inside again, atm I got a lot to do... damn wood houses! Keep souping guys... |
